1.Definitions
In the following terms and conditions “the photographer” shall mean Stefanie Korherr trading as Stefanie Korherr Photography. “The client” is the person that receives a service from Stefanie Korherr Photography in return for payment.
These terms and conditions cannot be varied in any way by the clients unless such conditions are expressly agreed by the photographer in writing.
1.1 “Session Date” refers to the day and any related photography services that the client is specifically commissioning the photographer to perform.
1.2 “Work” means all photographic images, digital files, prints or other materials created by Stefanie Korherr Photography.
2. Payment
2.1 We have read and understand Stefanie Korherrs Photography price list, which has been confirmed for our portrait session, on payment of the non refundable deposit/booking fee. We agree that payment of the initial deposit/booking fee confirms the booking of a session with Stefanie Korherr Photography. The deposit/booking fee will be deducted from the cost of the client’s chosen package.
2.2 We acknowledge that in the event of a cancellation (means that the event is canceled by client and not rescheduled) of the portrait session we agree that the deposit/ booking fee will be forfeited. Stefanie Korherr Photography may allow a transfer of session date within three (3) months of the original session date.
2.3 Payment in full of the remaining balance will be due one week week before the session day or at the session date.
2.4 Full payment for any further orders added to your original package according to this agreement is required at the time of ordering.
2.5 Prices are subject to change without notice, however from the date of your viewing gallery is made available, prices are valid for you for 30 days.
3. Copyright
The copyright Designs and Patents Acts assign the copyright of the images to the photographer.
It is illegal to use or copy images in any way or manner without written permission by the photographer. Stefanie Korherr Photography retains all copyright.
4.Display
The client gives Stefanie Korherr Photography the permission to use/display any photographs covered by this contract to generally promote the business in advertising, social media, brochures, magazine articles, websites, sample albums etc.
The usage for any other purpose is to be renegotiated between the parties and requires specific permission. Should the client wish to use them for their promotional purposes they need to contact Stefanie Korherr Photography and negotiate this.
5. Failure to Perform
If Stefanie Korherr Photography cannot perform this agreement due to a fire or other casualty, strike, or other cause beyond the control of the parties, or due to illness, then the photographer shall return the deposit to the client. But shall have no further liability with respect to the agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or computer malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the photographer.
6. Communication
6.1 We accept the responsibility to contact Stefanie Korherr Photography, at least two weeks prior to our session date, to confirm details are correct and there are no alterations, to locations.
6.2 We agree to immediately advise the photographer in writing of any alterations in the details listed here including postponement or cancellation of the portrait session.
7. Client Usage
The client is obtaining prints for personal use only, and shall not sell prints or authorize any reproductions there of by parties other than the Photographer. Without permission from the Photographer, the client shall not download, copy, print, screen shot, use as a basis for derivative works, manipulate in any way, or otherwise use the photographer’s images.
8. Digital Negative files
8.1 Digital Negatives (JPEGS), are presented in high resolution supplied in JPEG format. Orders must be made within two weeks of your viewing gallery being made available, once orders are placed they cannot be altered.
8.2 All digital negatives (computer files) remain the property of the photographer. All packages include copy’s of the edited digital negatives to the client for their own
non-commercial use.
8.3 Should the digital negative files be lost, damaged of destroyed for the reasons beyond control, the photographers liability shall be limited to a full refund of any deposits and fees paid, but shall not include a refund for any goods already received.
9.Archiving
9.1 The client agrees by accepting the Digital Negatives that they are hereby fully responsible for maintaining and safely archiving the images and Stefanie Korherr Photography will not be held accountable for any lost, unreadable or damaged files of their images.
9.2 After 12 months from the clients session date, Stefanie Korherr Photography will no longer be responsible for storing the session image.
10. Force Majeure
We understand that Stefanie Korherr will not be responsible for events on the day out of their control, such as lighting, weather, clothing choices and choice of venue/locations. Images will reflect what is presented.
11. Additional client editing
As an artist, Stefanie Korherr Photography, retains complete control over the final look of the client’s images. Scanned images damage her reputation as a photographer by distorting and devaluing the image quality. Digital files may not be altered in any image manipulation program. For example, images cannot be changed from color to half black and white and color, or simply from color to black and white or cropped. This includes any Instagram, Facebook, or similar filter.
12. Delivery
The photographer will her best to deliver digital negative files as quickly as possible. However this could take up to 3 weeks. In busy periods it could take up to 4-5 weeks.
Changes of this contract must be in writing and signed by both parties. All parties have read this contract and full. By completing the following information it is understood that you have read and agree to the terms of this contract. This contract is not valid until all payments have been paid and the contract is signed.
